National Press Photographers Association v. McCraw
The Fifth Circuit rejected the facial First Amendment challenges to the challenged Texas drone provisions and affirmed dismissal of the federal preemption claims. It left possible as-applied constitutional defenses open and vacated the district court judgment on the due-process claims for lack of standing. The substituted opinion withdrew 84 F.4th 632. Certiorari was denied October 7, 2024.
